Issue:

Based on staff interview and review of facility documents, the facility failed to report an incident of unauthorized disclosure of a patient's medical information to the Department within 5 calendar days.Findings:On 2/10/12 at 1:45 p.m., the facility's investigation of the incident was reviewed with the Compliance Officer (CO). A review of the investigation showed that on 1/15/09, the facility's case manager (CM) had faxed a copy of an infant's discharge summary to an out of state business. The recipient of the fax called the facility's medical records department and left a message about receiving the fax in error. The facility was aware of the incident on 1/15/09 and notified the Department on 1/21/09 (1 day later than 5 calendar days).
