Issue:

Based on document review and staff interview the hospital failed to report a disclosure of, a patient's medical information to the department no later than five days after the disclosure was been detected by the hospital.Findings:On 5/9/12 at 11:40 a.m., the facility's investigation of the incident was reviewed with the Compliance Officer (CO) over the telephone. A review of the investigation showed that on 11/28/09 a Rapid Care Department (RCD) nurse gave Patient A's discharge instructions and prescriptions to Patient B. Patient B called the RCD about getting the wrong discharge instructions and prescriptions and he returned them to the facility and received the correct paperwork instructions. The hospital detected the disclosure on 11/28/09. The hospital reported the of Patient A's information to the Department on 12/7/09 (4 days late).
